project description

commercial use single-image commissions are for one-off works that, upon completion, will be used by the client for business, commercial, branding, &/or advertising purposes & will remain the exclusive property of the client in perpetuity
the work must require a low amount of conceptual labor & no additional expense on the artists part, & the majority of the reference material if licensed must consist of branded property already under the clients legal control
if you want something different or are confused abt how much labor is 'a low amount', check the 'noncommerical use commission' or 'graphic design bundles' listings for comparison
the number of gratis iterations ( i.e. versions of the final piece ) made at the clients request will be capped at a maximum of 5 before additional charges are applied

pricing outline

$120 base price will apply regardless of image description & continues to apply for all requests up to & including a single ( presumably human ) figure, with full-color rendering & shading, also assuming the project description is thorough enough to require no additional consultations or iterations beyond the 5 allotted gratis iterations
+$30 additional charges apply to additional figures, typography, special effects, & per-hour audio or video consultation sessions, at the artists discretion
+$60 additional charges apply to background rendering, all iterations in excess of the initial 5 free iterations, determined at the artists discretion
the client will be warned abt potential additional charges prior to being invoiced & all known charges will be calculated prior to the artists beginning work on the piece
a pricing breakdown example might work as follows: $120 base price with one character & full color + an additional character ( $30 ), typography ( $30 ), one video consultation ( $30 ), & full background rendering ( $60 ), with 6 iterations before the final ( $30 ) comes out to $300 total
a minimum nonrefundable down payment of 50% the total estimated cost of the work must be submitted prior to the work beginning. the client can pay the total estimated cost up front, but should they request a refund only 50% the total amount will be refunded
any additional costs incurred during production will be invoiced upon completion of the project

prerequisites to starting work

the client must submit a minimum 2 paragraph, maximum 2 page description of the contents of the commissioned image
i am aware that often clients come to an artist with only a partial idea or a feeling of what they want & i am willing to workshop the idea for an hour preceding proposal submission over audio or videochat for an additional $30 fee added to the estimated price of the work
any consultation over text is subject to the attention & communication limitations of the medium &, tho incur no extra charge, will be attended to or ignored at the artists discretion & do not count towards the work in any way. as a warning, text conversations abt the work exceeding 3000 words of correspondence are liable to result in the artist terminating the speculative project. therefore the $30 consultation is recommended

terms of completion

the work is complete upon the artist receiving full compensation for the work & after the client has received the full resolution version ( or .psd file ) of the final iteration, at which point all rights to the work transfer to the client
if the artist wishes to post the work to their social media &/or portfolio, a request will be sent with the final iteration submission for the client to authorize the artists use of the work in this or other specified ways

terms of project termination

i, the artist, am incentivized by a desire for respect from my clientele, a desire for full payment, lov of my craft, & a wish to perform to the best of my abilities at everything i do to complete every project, however, for the sake of my mental health, i retain the right to reject any proposal or terminate work on any project for any reason with zero obligation to refund the down payment on the work, as a matter of protecting my ability to continue to work. if this offends u as a client, u can take it up with commiss.io who have cancellation policies that lean more in favor of client compensation shld the artist fail to complete the project at no fault of the client

License Description:

Standard agreement with additional commercial use authorization for the client.

1. This Agreement

This project agreement is between the artist and client. Commiss.io is a neutral third party providing hosting, technology, and dispute resolution services.

This license and agreement is entered into between the artist and the client (the “parties”). The parties are members of Commiss.io and have agreed to the Terms of Service as part of their membership. This agreement applies to relevant projects entered into by the parties when purchasing or selling services. The Terms of Service applies to all projects on Commiss.io.

This agreement is only between the parties. Commiss.io is the provider of technology and management of the platform and is not a party to this agreement.

This agreement takes effect when both parties agree to a project, price, and license. The project refers to the specific service to which this agreement is attached. Any and all communication and materials associated with the project are part of the project.

This agreement constitutes a legal contract. The artist is engaged by the client as an independent contractor to complete the job. There is no employment relationship established by this agreement.

2. The Project

This agreement only applies to the project it is attached to and only to the scope of the project as agreed. Either party may change the agreement or the scope of the agreement with written consent of both parties.

This agreement is attached to a project, as agreed upon by the artist and client. This agreement applies only to the materials within the scope of the project as outlined above. It is the responsibility of both parties to ensure positive communication about ongoing projects.

The project agreement may change at the request of the artist, with approval from the client. The project price may also change at the request of the artist, with approval from the client. If the scope of the project is changed, the artist should request a change of price as appropriate.

Upon completion of the project, the artist will submit the final assets. These will be available in a preview mode until accepted by the client. The client has 30 days to accept the final assets, request changes to the final assets, or request a cancellation of the project. If the client does not take any action for 30 days, the project will be considered "accepted" by default, and closed.

3. Payment

Payment is handled as outlined in the Terms of Service. Payment information is collected upon the initial request, and the client is charged at the start of the project.

4. License of Project Assets

The client receives an exclusive, royalty free license for commercial use of any original project assets, and a non-exclusive license for premade project assets, as outlined below.

For any project assets created specifically for the purposes of this project, the artist grants the client an exclusive, worldwide, royalty free license for all commercial use of the project assets. Unless otherwise agreed by the parties, the artist may continue to display any project assets as example materials, in online and offline portfolios, and to prospective clients. Unless otherwise agreed by the parties, the artist does not retain the right to use the completed work for commercial purposes, including selling digital or physical copies of the completed project assets.

For any pre-existing portions of project assets created by the artist, the client is granted a non-exclusive, worldwide, royalty free license for all commercial use of the relevant project assets.

Unless otherwise agreed upon by the parties, no attribution is necessary.

5. Cancellation and Refunds

Cancellations are subject to the terms selected by the artist and agreed upon by the parties prior to the start of the project.

Either party can request a cancellation prior to the successful completion of the project by using the “Contact Staff” button on the project page. It is recommended that the parties attempt to resolve any issues between themselves prior to requesting cancellation. Upon cancellation, the obligations of the artist to complete and deliver project assets are terminated. Funds will be returned to the client minus any applicable cancellation fees.

Cancellations as a result of artist action or inaction will incur no cancellation fee. Examples include, but are not limited to: an unresponsive artist and project materials outside the agreed scope.

Cancellations through no fault of the artist will incur a cancellation fee according to the cancellation policy associated with the project listing.

Cancellations and cancellation fees are subject to the Commiss.io Dispute Resolution process outlined below.

6. Dispute Resolution

Commiss.io staff provide dispute resolution, should the need arise. Disputes may be raised during or shortly after project completion. Commiss.io will make an ultimate decision regarding the project outcome intended to mutually benefit both parties.

The parties agree to participate in and be subject to the Commiss.io dispute resolution process as outlined in the Terms of Service. A dispute may be raised within 7 days of project completion by using the “Contact Staff” button on the project page.

It is greatly recommended that the parties attempt to reach an amicable solution between themselves prior to raising a dispute, though Commiss.io staff is available to provide assistance without raising a formal dispute.

As outlined in the Terms of Service. If a dispute is raised, Commiss.io will attempt to assist the parties in reaching a solution. Failing that, Commiss.io reserves the right to make an ultimate decision regarding the project outcome, relevant refunds, and any necessary transferring of intellectual property rights or project asset licenses.

7. Miscellaneous

This agreement is bound to the Commiss.io Terms of Service and those terms are incorporated to the greatest extent permissible by law, into this agreement. In the case this agreement is inconsistent with the Commiss.io Terms of Service, those terms take precedence over anything within this agreement.
