GENERAL
Primary Terms Of Service:
- I will NOT draw for NFTs, period.
- I will NOT draw any pornographic or sexually suggestive themes. Please keep it PG-rated.
- I will NOT accept character reference material containing genitalia, even if it is tasteful.
- I will NOT do any holiday, national, or religious themed artwork.
- I will NOT draw any political or controversial subjects that would otherwise invite negative attention or cause me undue stress or anxiety.
- You may NOT alter my work unless you ask permission first.
- You may NOT use my work for commercial, advertising, or personal gain.
- Prices listed will vary depending on complexity, props, and background.
- Reposting is permitted as long as you credit the artist.
- Progress sketches will be provided via email.
Commissions may be chosen based on personal preference and circumstances of the Artist, who reserves the right to decline a commission request form for any reason aside from the primary terms above.
You are free to ask the Artist for content not previously drawn, but you should expect the completed work to be within range of the Artist's established range, previous works, and style of work.
Commissions are only open to adults who are of the legal age of 18 or above and who are suitable to conduct business matters. Minors are not eligible to receive the services listed below relating to business and legal activities with another adult.
PAYMENTS
Payments are to be made through PayPal, Square invoices, or Stripe.
Higher complexity or requests that are not outlined in the request form may incur additional fees.
All payments must be completed in full before work begins (unless a payment plan is specified) If no payment is received within 48 hours of the invoice, your commission slot may be cancelled.
REVISIONS
It is the responsibility of the commissioner to ensure that their desires are clearly stated in the commission form and in follow-up communication with the Artist. This includes character references, pose references, or any other information provided.
Minimal changes are free. More complex changes will incur additional fees according to Artist's discretion.
If the Artist is found to have made an error, such revisions are free of charge, so long as they are validated against the reference images and details that were proposed in the original commission form.
Revisions made after the image is completed will always incur a fee according to artist's discretion.
DEADLINES AND DELIVERY
Services that allow for WIP (work in progress) images will be shared at the rough/sketch phase for commissioner's approval. If changes are requested, a revision WIP will be provided. If the revision is not approved and the commissioner choses not to move forward, the commission will be declined, and a partial refund will be issued.
The Artist may prioritize personal affairs on occasion. Major delays that exceed the scope of the proposal deadline will be communicated to the commissioner.
Commissions will be delivered through your preferred channel, ideally through email. It is the commissioner's responsibility to save completed works. Refunds will not be provided if works are lost, damaged or stolen. Backups will be provided upon request.
Commissions are to be treated as without deadline, but will be completed within a worthwhile window of time. If deadlines are requested, then a rush order fee will be incurred.
Orders that involve payment plans will tend to have longer deadlines and will be completed following the timing of payments. The Artist will not complete work if not paid in full, but work may progress in phases based on amount received at artist's discretion.
USE
The Artist retains all commercial and non-commercial works they create which includes the right to redistribute, promote and profit, as well as any right afforded by Copyright Law. This includes right to post finished works on social media, Patreon, Ko-Fi, etc. unless privacy is indicated.
Unless permitted, finished work is for personal, non-commercial use only. You may not reproduce or distribute it under any circumstances. Reposting to galleries and social media and printing for non-commercial use is permitted with credit or watermarks retained.
Unless expressly permitted, you may not change or alter the completed image. Absolutely no alteration of the work via generative AI is permitted. Violation will result in blacklisting you from any future commissions. You may inquire the Artist if you wish to make changes, so long as you divulge the nature of the changes you wish to make.
Unless expressly permitted by the Artist, a commissioner may edit or complete a sketch or linework with their own rendering or coloring, by the commissioner and the commissioner only. The commissioner is not allowed to pay another 3rd party to complete sketches with linework or color services, as the terms herein overstep the initial party of two, and services involved in completing the work herein is not open to a 3rd party. Violations will result in pursuing an additional 30% charge fee of the completed work.
INTELLECTUAL PROPERTY RIGHTS
Intellectual Property Rights to character depictions are retained by their respective owners, whether it is the commissioner, the Artist, or a 3rd party.
No person or entity has the right to copy, trace, edit, sell, distribute, or remove the Artist’s intellectual property; this includes characters and/or signature from a commissioned work. Anyone found doing so will be subject to legal action; up to and including all damages, a 35% licensing fee, and attorney’s fees.
REFUNDS
All refunds are subject to Artist's discretion.
Full refunds are only available to commissioners prior to work starting, or if the Artist terminates the commission if it cannot be completed in a timely manner.
Partial refunds will only be issued if the work is cancelled after work has begun.
Refunds will not be issued if the commission is cancelled under the following conditions:
- No response from the commissioner for 14 days
- The commissioner makes unfounded defamatory remarks regarding the Artist’s business via social media or other public posts
- The commissioner is found to be commercially publishing the Artist's or other artist’s work without permission
- The commissioner accepts a completed commission, but fails to report any errors within 48 hours
It is the responsibility of the commissioner to reach out to the Artist before filing a dispute, and do so in good faith that the Artist will resolve any dispute you may have. All disputes are to be handled via email and both parties guarantee to respond in a timely manner.
If a commissioner is found to have issues a chargeback or is found to have done so in the past as a malicious practice, the commissioner will be blacklisted from all future commissions.
COMMUNICATION
The artist assures open and accessible communication throughout the commission process, either through email, Discord, or Telegram.
All communication is to be in written form, no voice calls will be conducted.
After a commission is completed, the commissioner must notify the Artist of any errors in the work in order to fix them in a timely manner.
Timely communication is required of the commissioner as workflow is impacted and the ability of the Artist to dedicate time to each commissioner. Failure to respond to any correspondence after 14 days will result in cancellation of your commission slot and your payment not refunded.
Discussing commission details and transactions over livestreams or in non-private channels is not permitted. All commission matters are to be discussed privately via email, Discord private message, or Telegram private message.
Any public communication of harmful or unfounded derogatory remarks regarding the Artist's business on spaces such as Twitter, BlueSky, FurAffinity, etc. will result in immediate cancellation of your commission, a blacklist from future commissions, and payments will not be refunded.
